Declaration of data protection

§ 1 General

Your personal data (e.g. title, name, address, e-mail address phone number, banking details, credit card number) will be processed by VAG exclusively in accordance with the provisions of Federal Data Protection Act (Act for protection against the misuse of personal data in data processing). The following regulations provide information about the kind, extent and purpose of the collection, processing and use of personal data. This declaration of data protection only refers to VAG’s own websites. If you are transferred from our websites to other sites via links, please inform yourself about how your personal data are handled on these websites.

§ 2 Automatic data collection

For technical reasons, the following data transferred to us by your Internet browser are collected:

 

• Browser type and version
• Operating system used
• Website from which you visit ours (Referrer URL)
• Website you visit
• Date and time of your access
• Your Internet Protocol (IP) address

 

These anonymous data are stored separately from any other personal data you may have transmitted to us so that no conclusions as to a specific person can be drawn. The data will be evaluated for statistical purposes to allow us to optimise our Internet presence and our offers. These data will be deleted after evaluation.

§ 3 Inventory data

(1) To the extent required for the creation, contents or amendment of the contractual relationship, your personal data (inventory data) will be used exclusively for the performance of contracts. For the delivery of goods, for example, your name and address must be transmitted to the forwarder of the goods. Your personal data will not be made available to third parties not involved in the performance of the contract without your express consent or without legal foundation.
 
(2) Upon request by the authorities in charge, VAG is permitted to provide information about inventory data in specific cases should this be required for the purpose of criminal prosecution, to enable police authorities of the states to avert dangers, to allow the federal and state offices for the protection of the constitution the Federal Intelligence Service or the Military Counter-Intelligence Service to fulfil their legal duties, or for the enforcement of intellectual property rights.

§ 4 Data on use of services

(1) Your personal data required to enable you to make use of our offers and for the settlement of accounts (data on use of services) are used for the performance of the contract. Data on use of services include in particular your identity characteristics, information about the beginning and the as well as the extent of the specific use, and information about the tele-services used by you. VAG is permitted to transfer use data for the purpose of settling accounts (so-called account settlement data) to other providers or third parties to the extent and if this is required for settling the user’s account. After our accounts have been settled in full, these use and account settlement data will be deleted. Should the deletion of such data be prohibited by legal, statutory or contractual retention periods, the data will be frozen.
 
(2) Beyond the above, VAG will use such use data for the purpose of advertising, market research or for the preparation of offers tailored to the customer’s specific needs to create user profiles for which pseudonyms will be used. You are entitled to disagree with this kind of use of your use data. The user profiles will not be linked with your personal data.

§ 5 Information about cookies

So-called cookies are used to recognise the repeated use of an offer by the same user. Cookies are small text files stored on your computer by your Internet browser. VAG uses them to optimise our Internet presence and our offers. The cookies are so-called session cookies which will be deleted at the end of your visit. No personal data are collected by these cookies.

§ 6 Inquiries about personal data

Upon your written request, we will inform you which of your personal data (e.g. name, address) VAG has stored.
